Welcome to Meerkat AI. These Terms of Service ("Terms") govern your access to and use of our website meerkatapp.ai, including any related subdomains (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Account Creation and Security
To access certain features of Meerkat AI, you must register for an account using a valid email address and password.
You agree to provide accurate, current, and complete information during registration.
You are solely responsible for safeguarding your account credentials and for any activity that occurs under your account.
You must notify us immediately at support@meerkatapp.ai if you suspect any unauthorized access or breach of security.
2. Intellectual Property Rights
Meerkat AI, including its original content, features, database architecture, design, logos, and software code, is and remains the exclusive property of Marc Hepburn and is protected by international copyright, trademark, and intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the platform for your own internal business purposes. You may not copy, reverse-engineer, modify, or scrape our software infrastructure.
3. Subscriptions, Billing, and Merchant of Record
Our subscription billing, payment processing, and global tax collection are managed entirely by our third-party Merchant of Record, Paddle (Paddle.com Market Limited).
By subscribing to a paid plan, you authorize Paddle to charge your chosen payment method for the recurring subscription fees.
Cancellations & Refunds: All subscription cancellations, automatic renewals, and refund processing are governed by our separate Cancellation & Refund Policy, which is incorporated into these Terms by reference.
We reserve the right to adjust subscription pricing at any time. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.
4. Acceptable Use and Restrictions
You agree not to use Meerkat AI for any unlawful purpose or in any way that violates these Terms. Specifically, you agree not to:
Use our automated interface or API variables to disrupt, overload, or harm our server architecture.
Input data that violates any third-party intellectual property or data privacy rights.
Attempt to bypass or manipulate account parameters to access paid features without an active subscription.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Meerkat AI is provided on an "as-is" and "as-available" basis.
In no event shall Marc Hepburn or Meerkat AI be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:
Your access to or inability to access or use the Service.
Any temporary server downtime, maintenance windows, or technical interruptions.
Any data processing anomalies resulting from third-party artificial intelligence engines or search index APIs (such as OpenAI, Anthropic, Gemini, or search APIs).
6. Governing Law
These Terms and any dispute arising out of or related to your use of the Service shall be governed by and construed in accordance with the laws of Jersey (Channel Islands), without regard to its conflict of law principles.
7. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
